Terms & Conditions

1. Definitions

 

“Agreement” These General Terms & conditions including the charter Quote and any subsequent written amendments agreed between the parties.

 

“Charter Quote” The flight and Additional Services quotation document setting out price, Flight details and taxes payable and any other additional terms and conditions.

 

“Flight” Any flight booked for the customer as set out in the charter Quote.

 

“Force Majeure Event” includes an event or circumstances beyond control caused by adverse weather conditions, mechanical breakdown, unexpected flight safety shortcomings, security or health risks, air traffic control decisions, unexpected airspace or airport restrictions or closure, unexpected exercise of authority by government or other competent authority, political instability, terrorism or war.

 

“Permissions” Customs and immigrations permits, operational restrictions, takeoff and landing slots, other permits and requirements.

 

2. Charter Quote

 

2.1 All flights remain subject to availability until customer has signed the Charter Quote and has complied with applicable payment terms.

 

2.2 Unless otherwise specified, the Charter Quote includes the cost of the aircraft and positioning, crew, maintenance, air navigation and airport charges, taxes, fuel costs and standard                      catering and excludes any additional services.

 

2.3 The flight time mentioned in the charter Quote are representations under NIL wind conditions and billing would be on actual time Block time (i.e from engine Start to Engine switch off), depending upon the weather/wind/fog/visibility conditions.

 

2.4 Minimum 02:00 hrs flying time will be charged on everyday basis. The flying time quoted above is approximate and may vary. The final settlement of bills shall be done on actual hours flown, over and above the estimated flying time i.e from base to base.

 

2.5 Any watch hour extension, if levied by the Airport Authority of India (AAI), will be charged on actual, the copy of the bill from AAI will be forwarded along with the final invoice.

 

2.6 Any additional charges levied by Airport Authority, Customs/Regulatory authorities, shall be billed separately.

 

2.7 In case of Defense Airport, flying is subject to getting the clearance (AOR/NOR) from the concerned authority.

 

2.8 IFS (International Flight clearance Service) charges are applicable, for flights operating in the international sector.

2.9 Government taxes & levies if any, will be paid by the customer.

 

3. Force Majeure

 

3.1 Operator does not hold itself responsible for non-operation of charter for reason of Force majeure and shall be under no obligation or liability to the Customer.

 

3.2 We always obtain the destination weather before departure. However, if due to sudden deterioration of weather en-route/destination, the aircraft cannot land at the Destination airport OR diverted due to defense services activity AND has to return to the starting point or divert to some other airport, the actual flying time would be chargeable and balance if any, would be payable / refundable.

 

3.3 Operator is not responsible if any technical snag developed in the aircraft which cannot be rectified within the time limit and effect the operation of flight.

 

4. Customer Obligations

 

4.1 Customer is responsible for obtaining and holding all travel documents for travelling passengers and follow strict adherence to all local and international laws with respect to passengers as well as cargo.

4.2 Customer must not engage in illegal activities or carry any contraband items which may result in the seizure or forfeiture of the aircraft or cause it be operated for an unlawful purpose or unsafe manner.

5. Cancellation Charges

 

  1. 25% of the total estimated charter cost will be levied if the flight is cancelled any time after blocking of the aircraft till 72 hours of the scheduled departure.

  2. 50% of the total estimated charter cost will be levied if the flight is cancelled within 48 of the scheduled departure.

  3. 100 % of the total estimated charter cost will be levied if the flight is cancelled within 24 hrs of the scheduled departure.

 

6. Payments

The charge stated in the Charter Quote is payable in full advance before the flight departure. Customer understands and agrees that meeting this deadline is an essential condition of this            Agreement and until complied with all Flights will remain subject to availability and may be cancelled without any liability to customer.

 

Important Note: We require passenger names, nationality, passport no., and date of issue and date of expiry of passport well in advance to obtain necessary security clearances.
